1. Acknowledgement of these Terms and Conditions

1.1 By making a purchase, the customer acknowledges having read and accepted in advance the present general terms and conditions of sale relating to our e-commerce site, BRUYERRE, and accepts them without reservation. Placing an order on BRUYERRE and clicking the checkbox indicating acceptance of these terms implies the customer's full, irrevocable, and unconditional agreement to the present general terms and conditions of sale.

1.2 The customer's purchasing conditions cannot take precedence over our general terms and conditions of sale and will therefore be considered null and void.

1.3 Access to and use of this website are subject to prior acceptance of these general terms and conditions. By visiting this website or using the information it contains, you automatically accept the general terms and conditions. BRUYERRE may modify these terms at any time.

2. Product characteristics

2.1 The texts and illustrations of the various products are provided for information purposes only; they are not contractual and do not engage the responsibility of BRUYERRE, nor do they affect the validity of the sale.

2.2 The customer may obtain additional information about the characteristics of the selected product(s) by sending a written request to: webmaster@bruyerre.be

2.3 The products offered by BRUYERRE have been rigorously selected and come mainly from national and international companies with a strong reputation in the food service industry.

2.4 If an item ordered on the site becomes unavailable, we will inform you as soon as possible. You will then have two options:

1) Wait until the product is available again.

2) Request a refund for the unavailable item.

3. Prices

3.1 The prices offered are net, including a 21% tax (Belgian regime), excluding delivery and handling fees.

3.2 BRUYERRE remains open to any request from a customer regarding a large-volume purchase. A specific request can be sent to webmaster@bruyerre.be, and a preferential offer will be sent to the customer as soon as possible.

3.3 For Belgian professionals, an invoice will be issued with the possibility of recovering this tax if, during registration, the customer has provided their VAT number, beginning with BE 0 followed by 9 digits (e.g. BE 0123.456.789).

3.4 For foreign professionals or taxable persons, BRUYERRE will also issue an invoice containing the customer's details. If the foreign customer (outside Belgium) also has a VAT registration number in their country (e.g. FR 0123456789) and after verification of this number by the relevant authorities, BRUYERRE will invoice the purchased items at the pre-tax price (i.e. the displayed price minus 21% VAT).

3.5 For individuals and professionals who are not subject to VAT, BRUYERRE will issue an invoice for purchases made at the prices indicated on the website at a non-recoverable tax rate of 21%.

3.7 Prices may vary between BRUYERRE stores and the webshop. Delivery and maintenance costs may differ depending on the services and products, as well as the human and material resources required.

3.8 As prices may vary significantly due to the coronavirus crisis and the scarcity of raw materials caused by various global conflicts, the price displayed may no longer be valid at the time of ordering. As selling at a loss is prohibited in Belgium, Bruyerre will contact the customer to cancel the order and refund them.

3.9 ‘Prices and fluctuations' : The prices displayed on our website are updated periodically, but may vary depending on market fluctuations. As a result, the final price charged may differ from the price initially displayed at the time of ordering. The customer accepts this possibility and acknowledges that prices may be revised based on actual costs at the time of billing. 

4. Delivery time

4.1 The average delivery time is 3 to 5 days for Belgium, 5 to 7 working days for the Netherlands, Luxembourg, Germany & France for products in stock, after receipt of payment (non-contractual data) and acceptance of the order.

4.2 BRUYERRE shall notify the customer if a longer period is required to fulfil their order.

4.3 If the delay exceeds 30 days, the customer shall be entitled to cancel all or part of their order, unless the customer has previously agreed to a later delivery date.

5. Order

5.1 Once the order has been registered on BRUYERRE, the customer will receive a confirmation email containing the details of their order.

This will be considered final, and BRUYERRE will not be held responsible for any errors made by the customer (wording, shipping details, etc.).

5.2 Confirmation of the order implies acknowledgement and acceptance of these terms and conditions of sale and waiver of the right to invoke one's own terms and conditions of purchase or other terms and conditions.

5.3 BRUYERRE reserves the right to suspend or cancel any order from a customer with whom there is a dispute regarding payment for a previous order or in the event of a payment incident.

5.4 BRUYERRE reserves the right to suspend or cancel any customer order for which there have been multiple shipments of the same goods (at least the initial shipment and a second shipment) if a recurring problem occurs during delivery (loss/breakage/damage). In this case, the customer will be reimbursed for the goods not received and taken back by BRUYERRE.

5.5 We reserve the right to refuse an order if the price and/or specifications of a product mentioned on the website prove to be incorrect due to a technical fault or human error.

5.6 Products listed in the ‘Promotions’ section are sold while stocks last.

6. Payment

6.1 The total amount is payable upon placing the order. The total amount includes the price of the entire item + the cost of transport.

6.2 The order shall be deemed effective upon payment of the full amount of the invoice and confirmation by the financial institution that payment has been received.

6.3 The various payment methods accepted :

•    Credit card (MasterCard, Visa): (Credit card number, expiry date, security code)

•    By debit card

•    By bank transfer (longer processing time)

7. Delivery

7.1 BRUYERRE does not allow partial deliveries, as shipping costs are calculated on a single shipment per order.

However, in the event that part of the customer's order is out of stock (see Article 5), the customer may, if they wish, have the available part delivered, with the second shipment being at the customer's expense, unless specific written specifications have been agreed between the customer and BRUYERRE.

7.2 The delivery countries are indicated when placing the order. We deliver to the following countries: Belgium, the Netherlands, Luxembourg, France, and Germany. For any other delivery requests to foreign countries, please contact: webmaster@bruyerre.be​

7.3 BRUYERRE partners with B-Post for the delivery of domestic orders :

The delivery address is the one provided by the customer when placing the order.

For this type of shipment, the parcel will arrive at the recipient's address on the working day following receipt of payment.

If the customer is absent, the postal service will make a second delivery attempt. If the parcel is still not collected on the second attempt, a delivery notice will be left in the letterbox. The parcel can be collected from your post office within 15 days before it is returned to our offices.

Furthermore, in the event of an order being returned, regardless of the reason, the costs of the new and second shipment will be charged to the buyer.

7.4 BRUYERRE partners with B-Post and GLS for intra-European shipments: Same remarks as for domestic shipments, delivery time is approximately 3 to 5 working days after receipt of payment.

7.5 In the event of any delays, BRUYERRE cannot be held liable if the buyer is not up to date with their contractual obligations (insufficient address information, absence of the recipient, strikes, adverse weather conditions, etc.).

7.6 Upon delivery, the buyer is required to check the condition of the order.

If any products are damaged, the customer shall indicate on the receipt: ‘package received damaged’ and shall contact BRUYERRE within 48 hours of receiving the damaged package. If a problem arises during delivery, the customer shall also contact BRUYERRE within 48 hours of notification or a call from the carrier.

7.7 In the event of failure to comply with this procedure, BRUYERRE cannot be held liable for any damage caused during delivery, and the customer will therefore not be entitled to request a refund or exchange of the damaged goods.

7.8 Once the goods have left our premises, delivery is subcontracted to the relevant professional delivery service. If the goods are received damaged or broken, the subcontractor (Bpost/Chronopost/DPD/GLS) is liable, and BRUYERRE is released from any liability.

However, BRUYERRE undertakes to handle all disputes with subcontractors in collaboration with the purchaser.

8. Delivery costs

8.1 Our system calculates and offers various delivery options. We offer: a standard door-to-door service (B-Post nationally, as well as to France, Germany, the Netherlands and Luxembourg) or pallet delivery for fragile products via GLS.

8.3 You can collect your order free of charge from our various stores (see the ‘Points of sale’ page) between 9 a.m. and 5 p.m. Monday to Friday.

9. Satisfaction

9.1 The customer benefits from a ‘satisfaction or money back’ guarantee.

If the customer is not satisfied, BRUYERRE undertakes to refund the amount paid for the products delivered by bank transfer or to exchange them; this amount is calculated on the basis of the purchase price minus any damage or additional costs.

Returns are at the customer's risk. We do not accept returns that have not been previously notified.

9.2 Returned goods

In the event of withdrawal, a letter, email or standard withdrawal form must be sent to us.

The goods must meet the following conditions:

• Returned within 14 days of receipt.

• Be in original new condition.

• Be in its original packaging, with all its accessories (user manual, cables, etc.)

• Supplied with a copy of the invoice/delivery note.

In addition, shipping and packaging costs are payable by the customer, unless there is an error on our part.

9.3 For special orders and sealed items, the customer will not be entitled to this return guarantee.

The shipping costs and risks associated with the return are the responsibility of the customer and will therefore not be refunded unless the item is defective or was sent incorrectly by BRUYERRE.

9.4 For reasons of hygiene and food safety, we cannot accept returns of food products. We are unable to guarantee that these products have been stored under optimal conditions and that they have remained intact after delivery.

10. Warranty

10.1 All items are guaranteed for one year against any defects.

This warranty is valid if the instructions for use and maintenance are followed.

In this case, BRUYERRE undertakes to either repair or replace or, if necessary, refund any defective item.

10.2 Our warranty does not apply to normal wear and tear or damage resulting, after the transfer of risk, from incorrect handling or negligence, excessive use, unsuitable accessories or other influences not provided for in the contract.

10.3 The following are also excluded from the warranty: bulbs, seals, heating elements, etc. (any ‘consumable’ part that needs to be replaced at regular intervals due to normal use of the appliance).

11. After-sales service

11.1 A technical team is available to assist customers with any questions regarding the use of our products, or relating to any breakdowns or malfunctions thereof.

11.2 A copy of the invoice must be enclosed with the returned item, and the customer will be responsible for the shipping costs.

After intervention by the technical service, the item will be returned at BRUYERRE's expense if it meets the warranty criteria. Otherwise, the customer will pay in advance for the cost of repairing the device and the cost of returning the goods.

12. Applicable rights

12.1 Belgian law applies to all agreements between BRUYERRE and the customer.

12.2 In the event of any disputes, these shall be brought exclusively before the courts of the Judicial District of CHARLEROI and, where applicable, the Justice of the Peace of the First Canton of CHARLEROI (Belgium). Information on alternative dispute resolution methods can be obtained via the link http://ec.europa.eu/odr/, but we reserve the right to submit any dispute exclusively to the courts.

13. Property rights

13.1 BRUYERRE remains the legal owner of an item sold until the purchase price has been paid in full.​

13.2 All elements of this website (logos, text, photographs, etc.) are the intellectual property of BRUYERRE. Any reproduction, use or exploitation of the website's content is therefore strictly prohibited without prior written consent.
